Gold Coast City Council – Environmental train wreck
Council or other offender may face fines up to $4,000,000 if found to have caused serious environmental damage.
Investigations by Dept of Environment and Science into compliance breaches are now more urgent than ever. The OBSERVED SOURCE of black mud which has caused serious damage to the Coombabah catchment must be confirmed and the offender identified.
Unnecessary delay or refusal to remediate the damage could result in fines up to c.$4,000,000 plus the cost of remediation which will, if delayed, continue to increase over time. Delays may also result in breaches of International, Commonwealth, State and Local Government laws and agreements.

Conservation Act 1999 (Cth) (EPBC Act) in relation to:
(a) actions causing a significant impact on a matter of national environmental significance;
(b) the ecological character of a declared Ramsar wetland;
(c) listed threatened species and ecological communities;
(d) listed migratory species. -
Planning Act 2016 (Qld) in relation to ecological sustainability.

Coastal Protection and Management Act 1995 (Qld).

Environmental Protection Act 1994 (Qld) in relation to:
(a) ecosystems and their constituent parts, including people and communities;
(b) all natural and physical resources;
(c) the qualities and characteristics of locations, places and areas, however large or small, that contribute to their biological diversity and integrity, intrinsic or attributed scientific value or interest, amenity, harmony and sense of community; and
(d) the social, economic, aesthetic and cultural conditions that affect, or are affected by, things mentioned in paragraphs (a) to (c).
(e) serious environmental harm:
(i) that causes actual or potential harm to environmental values that is irreversible, of a high impact or widespread; or
(ii) that causes actual or potential harm to environmental values of an area of high conservation value or special significance; or
(iii) that causes actual or potential loss or damage to property of an amount of, or amounts totaling, more than $50,000. -
Fisheries Act 1994 (Qld) and Fisheries Regulation 2008 (Qld) in relation to fisheries habitat area or damage to marine plants (e.g. mangroves)

Marine Parks Act 2004 (Qld) – Damage to Marine Parks.

Nature Conservation Act 1992 (Qld) deals with the management of protected areas in relation to:
(a) the destruction of dolphin habitat
(b) marine plants (e.g. mangroves) and fish habitat including on inter-tidal land.

Coombabah catchment is an internationally protected migratory bird habitat, designated fish habitat under the Queensland Fisheries Act, a protected marine conservation and habitat zone under the Moreton Bay Marine Park Zoning Plan and a Ramsar Internationally protected wetland of significance.

There’s a rock wall that has been built higher and wider from Jabaroo island back over to a canal opening which has no opening at all which in turn has stopped the flow of water into the creeks that feed into the lakes namely the Runaway Lake there’s been no water movement into the lake in ages. There are no jumping fish at night anymore we use to get swans and ducks every day now only a couple turn up but don’t stay. Out of 80 odd dwellings 11 have their roof run off going to the storm drains the rest go to an underground pipe which flows into the lake when a house has it’s roof painted the runoff ends in the lake and consequently kills the fish how can this be happening in this day of being environmently friendly in a pigs ear. There was a Council man checking on the lakes water quality haven’t seen him in ages is everyone not bothered any more what happens here

Yes, initial inspection on Wed Aug 21, by DES and DAF in Fisheries boat with team of environmental scientists +1 rocket scientist from GCCC 🙂 . Discussions between DES and GCCC last Wed Sept 11. All gone very quiet since then…Usually a serious sign with investigations.
Wouldn’t expect anything less from thus Environmental Vandal GCCC led by environmental terrorist Mayor Tom Tate
